By accessing or using the Engz Car Services mobile application and platform ("Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services. We reserve the right to modify these terms at any time, and your continued use of the Services constitutes acceptance of any changes.

2.1 Platform Overview

Engz Car Services is a technology platform that connects users with independent service providers for car care services, including but not limited to car washing and car rental. We act as an intermediary and do not directly provide these services.

2.2 Service Availability

Services are currently available in Egypt and select regions within the MENA area. Availability may vary by location and time. We reserve the right to expand, limit, or discontinue services in any area at our discretion.

2.3 Service Providers

All service providers on our platform are independent contractors, not employees of Engz. While we vet and verify providers, we do not guarantee the quality of their work and are not liable for their actions or omissions.

3.1 Account Creation

To use our Services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Eligibility

You must be at least 18 years old to create an account and use our Services. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.3 Account Security

You are responsible for safeguarding your password and must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

3.4 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. You may also delete your account at any time through the app settings.

4.1 Service Booking

You can book services through our app by selecting your desired service, time, and location. Bookings are subject to availability and confirmation by service providers.

4.2 Pricing

All prices are displayed in Egyptian Pounds (EGP) and are subject to change without notice. The price you see at the time of booking is the price you will pay, unless modifications are made to the service.

4.3 Payment Methods

We accept various payment methods including credit/debit cards, mobile wallets, and cash. All electronic payments are processed through secure, third-party payment gateways.

4.4 Payment Authorization

By providing payment information, you authorize us to charge the applicable fees for services booked. You represent that you have the legal right to use any payment method you provide.

4.5 Refunds

Refund eligibility depends on the specific service and circumstances. Generally, cancellations made at least 2 hours before the scheduled service time are eligible for a full refund. Late cancellations or no-shows may incur fees.

5.1 User Cancellations

You may cancel or reschedule bookings through the app. Cancellations made more than 2 hours before the scheduled time receive a full refund. Cancellations within 2 hours may incur a cancellation fee of up to 50% of the service cost.

5.2 Provider Cancellations

If a service provider cancels your booking, you will receive a full refund and may be offered alternative providers or time slots.

5.3 No-Show Policy

If you are not available at the scheduled time and location, it will be considered a no-show, and you may be charged the full service fee. Service providers will wait up to 15 minutes before marking a booking as a no-show.

6.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not use the platform to engage in fraudulent, abusive, or illegal activities.

6.2 Prohibited Activities

You may not: (a) impersonate any person or entity; (b) interfere with or disrupt the Services; (c) attempt to gain unauthorized access to our systems; (d) use the Services for commercial purposes without authorization; (e) harass, threaten, or abuse service providers or other users.

6.3 Vehicle Condition

For car wash services, you are responsible for ensuring your vehicle is in a condition that allows safe service delivery. For car rental, you must return the vehicle in the same condition as received, normal wear and tear excepted.

6.4 Accurate Information

You must provide accurate information about your location, vehicle, and service requirements. Inaccurate information may result in service delays or additional charges.

7.1 Driver Requirements

To rent a vehicle, you must possess a valid driver's license and meet the minimum age requirement (typically 21 years). Additional drivers must be registered and approved.

7.2 Vehicle Use

Rental vehicles must be used in accordance with local traffic laws and regulations. Vehicles may not be used for: racing, towing, off-road driving (unless specified), transporting illegal goods, or subletting to third parties.

7.3 Insurance and Liability

Basic insurance is included with all rentals. You are responsible for any damage, theft, or loss not covered by insurance. Optional comprehensive coverage is available at an additional cost.

7.4 Fuel Policy

Vehicles are provided with a full tank of fuel and must be returned with a full tank. Failure to refuel will result in refueling charges plus an administrative fee.

7.5 Mileage

Rental packages may include limited or unlimited mileage. Exceeding mileage limits will result in additional per-kilometer charges as specified in your rental agreement.

7.6 Vehicle Return

Vehicles must be returned at the agreed time and location. Late returns may incur additional charges. Early returns do not entitle you to a refund for unused time.

8.1 Ownership

All content, features, and functionality of the Engz platform, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Engz Car Services and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

8.3 Trademarks

The Engz name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Engz Car Services. You may not use these marks without our prior written permission.

9.1 Service Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

9.2 Liability Limits

To the maximum extent permitted by law, Engz Car Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of profits, data, or goodwill.

9.3 Maximum Liability

Our total liability to you for any claims arising from your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

9.4 Service Provider Actions

We are not liable for the actions, errors, omissions, representations, warranties, breaches, or negligence of any service providers, or for any personal injuries, death, property damage, or other damages resulting from their services.

You agree to indemnify, defend, and hold harmless Engz Car Services, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your conduct in connection with the Services.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law provisions.

11.2 Arbitration

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Cairo, Egypt, rather than in court, except that you may assert claims in small claims court if your claims qualify.

11.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Engz individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated on a class-action basis.

12.1 Entire Agreement

These Terms constitute the entire agreement between you and Engz Car Services regarding the use of our Services and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.

12.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, or governmental actions.
